Fixed Fee Divorce in London and Essex

Based in London & Essex, our Solicitors Firm is registered with the Law Society of England & Wales and regulated by the Solicitors Regulation Authority and you can expect a high level of professionalism combined with a very competitive price when dealing with your divorce or separation. Our current Divorce fixed fee is £500 plus VAT and Court fees.

In some cases, it may be possible to recover your fees from your ex-partner. Our solicitors can advise on all the options open to you when it comes to funding a divorce action. Furthermore, Milner Elledge offer a number of optional services during the divorce process.

About our Fixed Fee Divorce

We provide a fixed fee for all divorces where both parties cooperate.  

Our fixed-price divorce does not apply where:  

  • The divorce is defended 
  • You or your spouse are not residents in England & Wales

If you are the "Applicant" (you are the one initiating the divorce proceedings):

If you are the "Respondent" (your spouse or civil partner is issuing the proceedings):

Important Information

Our fixed price divorce includes:  

  • An initial interview of up to an hour 
  • Letting you know what information we need 
  • Preparing all the forms and other documentation 
  • Corresponding with the court 
  • Corresponding with your spouse/civil partner or their solicitor 
  • Handling your divorce only up to and until the decree absolute is made (or when the conditional order is made final) 

Our fixed-price divorce does not include:  

  • Advising or representing you in relation to disputes over children or finances 
  • Amending divorce papers after they have been submitted to the court 
  • Representing you in disputes about costs or enforcing costs orders 

Additional costs that may apply:  

  • If you do not have your marriage certificate, the cost of a duplicate.
  • If your spouse or civil partner does not cooperate and it is necessary to instruct a third party to personally serve the divorce petition on them, there will be a charge for this. 
  • If your spouse or civil partner cannot be served with the divorce petition, we will charge an additional £100 plus VAT for applying to the court to allow us to serve the petition by other means or to allow the divorce to go ahead without service. The court will charge £45 for this application. 
  • The amount you have to pay might vary if the government changes court fees or the rate of VAT. 

Optional extras

  • Disbursements (expenses) such as the cost of obtaining a replacement marriage certificate. This is usually in the region of £7.00 and can be obtained either by yourself from the Registry of Births Deaths and Marriages or alternatively, we charge a fee of £20.00 plus VAT in addition to the Registry fee if you would like us to obtain it for you.
  • Translations of foreign marriage certificate. We have a range of translation agencies who will be able to assist in having your marriage certificate translated and an Affidavit prepared for the Court. We can arrange this for you and will advise you of their costs. We charge a fee of £30.00 plus VAT for this service in addition to their fees.
  • Tracing your spouse. If you do not know the whereabouts of your spouse, we have a worldwide network of enquiry agents whom we can contact on your behalf. We will obtain an estimate for you as appropriate.
  • Application for Deemed Service of the Divorce papers. If your spouse receives the papers but won’t file the acknowledgement, in certain circumstances a further affidavit is required in order to process your divorce for which we charge an additional £150 + VAT.

Pay as you Go

If you prefer to pay as you go, you can opt for our hourly rate option depending on the level of experience of your lawyer. With this option you would be able to plan in advance the fees at each stage and also have the flexibility of meeting any unforeseen issues that may arise relating to your divorce.
